Welcome to MyDroneUP. These Terms of Service ("Terms") govern your access to and use of the MyDroneUP website, mobile applications, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
MyDroneUP provides a marketplace connecting commercial drone operators ("Pilots") with clients ("Customers") seeking aerial data, photography, and inspection services. We act as an intermediary and are not a party to the actual service agreements between Pilots and Customers except where explicitly stated.
To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
All Pilots operating on the MyDroneUP platform must comply with local, state, and federal regulations. In the United States, this includes maintaining a valid FAA Part 107 Remote Pilot Certificate.
Pilots must also ensure that their equipment is properly registered and maintained in accordance with manufacturer specifications and regulatory requirements.
Customers can post "Missions" detailing their project requirements, location, and budget. Pilots may submit bids or accept fixed-price missions. Once a mission is accepted, a binding contract is formed between the Customer and the Pilot.
Payment Processing: MyDroneUP uses third-party payment processors. Funds are typically held in escrow until the Customer approves the final deliverables. We charge a service fee on each successful transaction, which is deducted from the Pilot's payout.
Unless otherwise agreed upon in writing between the Customer and the Pilot, the following rules apply to work product generated through the Platform:
Work Product: Upon full payment of the agreed-upon fee, the Customer shall own all right, title, and interest in and to the deliverables (e.g., photos, videos, data sets). The Pilot retains the right to use the deliverables for their professional portfolio and marketing purposes unless a Non-Disclosure Agreement (NDA) states otherwise.
Platform IP: The MyDroneUP name, logo, and all platform-specific code, designs, and features are the exclusive property of MyDroneUP and are protected by copyright and trademark laws.
To the maximum extent permitted by applicable law, MyDroneUP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Any dispute arising from these Terms or your use of the Platform will be resolved through binding arbitration in Wilmington, Delaware, except that you may assert claims in small claims court if your claims qualify.
